I won't take that decision, but the client might (and sometimes does).

So what you're saying is, you can't use js; the technology is there but,
hey, don't take advantage of it.

Not really. Use the technology, but be prepared for people not being able to
see it. If you want the maximum amount of people to be able to see your
site, then make the content available.

For example, how hard is it to have a lower tech version of your page
available for non-JS enabled browsers?

However, even if it was how many people do you want to think your site
sucks?

Also, what about people browsing on their mobile phones or from internet
kiosks? They are no interest to you?

At the end of the day, it is up to you how you design your site. If you want
to keep it to a select group of people who are using a specific
browser/computer/connection combination then fine. If you want to create a
presence on the web which will increase your exposure to as many people as
possible then guess what your goal is.

You cared enough for a site review request.

Were you hoping everyone would gush over your site and say how brilliant it
is? Very unlikely. Getting other people to look at your site is important -
if you don't want visitors why have a site? - however, it also means you
have to live with their comments. Even the ones you don't like.

with a viewing application and sending it out to people. That or an intranet

However, I assume from your comments that you don't explain the risk to
them. Do you know of any company that is prepared to turn away up to 5% of
its customers simply because its "too hard" to make a site that degrades
gracefully?

How hard is it to put a JS detection script in at the start and point the
failures to a text only sight. This will also mean you can cater for
hearing/visually impaired people, odd browsers etc.
