Hmm, thats interesting.
The site in question does indeed have 2 domains pointing to the same file(s)
and these 2 domains occupy the top 2 spots in google on a particular search
phrase. What if they registered 10 domains that all go to the same file(s)
and occupy the top 10 google results for a particular search phrase? Surely
thats bad for google because the search results become misleading.

Google will eventually figure it out; in my experience.
The additional domains will eventually be removed from the index.

I am curious about this line between good and evil. or maybe it's
just 'within guidelines' as opposed to 'breaking the rules'. I was
asked by my company to make use of some unused domains but I have so
far resisted because I personally think that the success rate of this
technique will decrease with time.
I understand that optimized redirects are not appreciated but it is
alright to share code bases with multiple domains. aparently this is
what your nemesis is doing and is successful enough to get your
attention. In this instance, I would call it a 'loophole'. unsavory,
yes, but not illegal. at least not right now. Instead of pointing
the finger to a company having success with this technique, I would
instead encourage Google to alter the way they handle this particular
situation so they can address it across the board.

I woudl go along with that.
But of course, hypothetically, someone may be losing money everyday because
of this apparently unfair situation.

So is pointing more than one domain to a site considered breaking
Googles rules?

I can think of numerous reasons why this would be a good idea. I have
not heard before that this is a violation. Mirror sites yes, but not
multiple domains.

And I have heard talk that Google can filter out spam but have yet but
see it.

Mark, have you downloaded the Google toolbar yet? It lets you see a
page's PageRank. i remember you were asking about PR a while back.
