Default waiver? - 12-17-2003 , 03:02 PM






Here's the situation:

Webdev X built a website for Company Y. Webdev X also hosts the site.
CompanyY has not been satisfied with the speed (or lack thereof) with which
the site was built along with a few other things. (Estimate was for 3 months
but it took a year).

Company Y has asked me to take over site maintenance and to move it to a
different web server, away from WebdevX. When company y notified them,
Webdev X asked them to sign a waiver stating:

"I will also need to forward you a waiver of support, stating that you have
made the decision to change web hosts (and developers); therefore WebdevX
will no longer be held responsible for any errors or functionality due to
changes in the site's code and structure. If needed, I will be happy to
provide you with the original Photoshop (design) files when I receive the
signed waiver. "

I'm not griping about it, I'm just wondering: are such waivers standard?

IMO webdevx is very sensibly drawing a line under the previous relationship.
ie: if you screw it up don't blame him for what's not in his control!

I don't know about standard, but it makes sense to me. We include something
similar in our contracts relating to: "If any changes are made by a
third-party, we are not responsible." Not exact wording, but you get the
idea. When a site is developed, it is most likely hosted somewhere where the
functionality will be provided for. Webdev X shouldn't be liable if things
go screwy due to a move, etc.

Right. Like I said I'm not griping about it. I'm just wondering if it is
standard as so far, I haven't had anyone take a site away from me that I
have built. I wouldn't have even thought of making someone sign a waiver.
I was just asking those who do this for a living if this was standard.
