Why use a Library item that is in a non-editable region of the template?
Your operational impact of removing this Library item and just putting in
the code would be zero, but the performance of updates to the page would be
much better. The same goes for your footer Library item.
Also, having an editable region inside an <h1> tag is going to give you an
annoying nag every time you make a change to this template.

As for your background image, I see it just fine in IE6/WXPPro.
