Check in/Check out flaw -

Hi guys,
Never posted here before, but I thought I would point something out that
my workmate and I discovered.
When my workmate finished with a file, he would save it and check it
back in.
However, he left the file open and edited later. In the mean time, I had
checked the same file out, put through edits and checked it back in.
He then made some more edits and checked his local over the the version
that I had just checked in.
Now, this is not a bug, it is a flaw in the process.
Okay, aside from my workmate making a silly mistake, the system did not
account for a file left open, then checked in again.
I imagine that some of you are working in a group of two or more. This
is my first time developing in a group of two. I am not the coder in
this project, so we only lost some page designs and layouts. However, if
the situation were reversed, we may have lost code and not known it.
This might not have been discovered until much later down the track.
Anyway, aside from working out ground rules for using this system, are
there some things that I have not done to set this up, so it doesn't
happen again?
